26-3-2025 (MANILA) The International Criminal Court’s prosecutorial team has furnished crucial evidence in the crimes against humanity case against former Philippine President Rodrigo Duterte.
The ICC’s chief prosecutor, Karim Khan, has confirmed the handover of 181 confidential items to Duterte’s legal representatives. These materials, designated as “package 001”, form the cornerstone of the arrest warrant issued against the former leader.
The pre-trial proceedings have entered a critical phase, with the confirmation of charges hearing set for 23 September. The Pre-Trial Chamber I has issued a comprehensive set of queries to both prosecution and defence teams, seeking clarity on various evidential aspects.
The prosecution must now address 15 specific inquiries from the tribunal, encompassing details about documentary evidence, witness testimonies, and multimedia materials including photographic, video, and audio documentation. The chamber has particularly emphasised the need for transparency regarding witness protection measures.
In an official three-page correspondence to the pre-trial chamber, Khan outlined the inter partes disclosure process, maintaining strict confidentiality protocols whilst ensuring procedural fairness.
The defence team has been tasked with responding to preliminary questions, including their stance on potential grounds for criminal responsibility exclusion. They must also indicate whether they require additional investigative time before the confirmation hearing and clarify their position on presenting counter-evidence and defence witnesses.
This disclosure marks a pivotal moment in the proceedings, adhering to the ICC’s fundamental principle of ensuring defendants are fully informed of the evidence to be presented against them during formal hearings.
