10-6-2023 (BEIJING) A man surnamed Ding, originally from Fujian Province, married a woman surnamed Chen after being introduced to her. The couple later moved to South Africa for work and eventually returned to China when Chen became pregnant.
As their daughter grew older, Ding noticed that her skin began to darken and her hair became curly. In addition, he discovered that his wife had contracted HIV/AIDS. Suspecting infidelity, Ding decided to take legal action.
During the court proceedings, it was determined that the couple would divorce, and the custody of their daughter would be granted to Chen.
According to reports from Chinese media, Ding and Chen got married through a matchmaking process in 2016. They relocated to South Africa after their marriage and had a son in 2018. In 2022, while Chen was pregnant again, the couple returned to China for prenatal care and eventually gave birth to a daughter.
As the daughter grew up, Ding and his family noticed that her skin had darkened, and her curly hair made her physical appearance noticeably different from both parents.
Furthermore, Ding discovered that his wife had contracted HIV/AIDS, while he remained uninfected. The couple’s constant disputes over these issues led Ding to file for divorce and seek compensation for emotional distress.
During the trial, it was revealed that Chen was indeed the biological mother of their daughter but Ding was not the biological father.
In the course of the proceedings, Chen confessed that she had engaged in a relationship and became pregnant with a local individual during their time in South Africa. It was only during prenatal check-ups that she discovered her HIV/AIDS infection.
Following court mediation, Ding and Chen agreed to divorce by mutual consent. Ding would be responsible for the financial obligations regarding the upbringing and education of their son, while Chen would bear the responsibility for their daughter.
Regarding the civil compensation claim, Ding, taking into consideration Chen’s health and financial situation, voluntarily waived his request for emotional distress compensation.
