10-3-2025 (MANILA) Amidst swirling speculation regarding a potential arrest warrant, the International Criminal Court’s Office of the Prosecutor (OTP) has maintained strict silence concerning former Philippine President Rodrigo Duterte’s case. The prosecutor’s office emphasised their unwavering commitment to confidentiality, deeming it paramount for safeguarding investigations and protecting those involved.
The controversy has taken an intriguing turn with Duterte’s appearance in Hong Kong, where he addressed overseas Filipino workers at a thanksgiving gathering. Legal expert Kristina Conti, Secretary-General of the National Union of Peoples’ Lawyers-National Capital Region, suggests the timing is particularly significant, noting Hong Kong’s connection to Interpol through its special administrative relationship with China.
At the heart of the matter lies the ICC’s ongoing probe into alleged crimes committed in the Philippines between November 2011 and March 2019, specifically focusing on the controversial “War on Drugs” campaign. The ICC, whilst lacking its own police force, relies on Interpol-affiliated national law enforcement agencies for executing arrests.
Political analyst Ronald Llamas presents a compelling theory, suggesting Duterte’s sojourn to Hong Kong might not be merely coincidental. He posits that China, an Interpol member, could have forewarned Duterte about an impending international warrant, potentially explaining his sudden departure from the Philippines. Llamas speculates that China might offer protection to the former president.
Speaking at the Hong Kong event, Duterte acknowledged awareness of the rumoured ICC arrest warrant. He defended his drug war policy, maintaining it was implemented to ensure peace and protect Filipino citizens during his tenure as president.
The situation presents a complex legal challenge, with Duterte’s camp potentially preparing to contest any international warrant through the Philippine Supreme Court. Meanwhile, the ICC’s investigation continues under strictly confidential protocols, with any formal arrest warrant announcement requiring a separate unsealing process.
