26-8-2024 (KUALA LUMPUR) A young couple faced the Sessions Court in Kuala Lumpur today, denying charges of child neglect after their three-year-old daughter tested positive for drugs last week.
The defendants, a 26-year-old businessman and his 21-year-old wife, stood before Judge Izralizam Sanusi to enter their plea. They are accused of neglecting their child at their apartment in Jalan Kuang Bertam, Kepong, at approximately 11 am on 19 August.
The prosecution, led by Deputy Public Prosecutor Nor Aisyah Mohamed Zanyuin, brought charges under Section 31(1)(a) of the Child Act 2001, in conjunction with Section 34 of the Penal Code. If found guilty, the couple could face severe penalties, including a fine of up to RM50,000, a maximum prison sentence of 20 years, or both.
In a measured decision, Judge Sanusi granted bail to both defendants, set at RM8,000 each, with the condition of one surety per person. Additionally, the couple must report to their local police station once a month and were strictly warned against any attempt to intimidate witnesses involved in the case.
The court has scheduled the next hearing for 10 October, allowing time for both the prosecution and defence to prepare their cases.
Representing the accused was Edwin Thomas, a lawyer from the National Legal Aid Foundation, highlighting the gravity of the charges and ensuring the defendants’ right to legal representation.
This case has sparked concern among child welfare advocates and the general public, raising questions about drug use in domestic settings and its potential impact on children. It also underscores the legal system’s approach to cases involving child neglect and substance abuse.
